ANA proposes to streamline its grant rules; comments due Nov. 13, 2026

Check: The Administration for Native Americans (ANA) proposes to shorten 45 CFR part 1336 and send appeals to the HHS Departmental Appeals Board, with written comments due 2026-11-13.

What it does

The proposal affects tribes, Alaska Native villages and corporations, Native Hawaiian organizations, and urban or rural Native organizations that apply for or hold ANA grants. It removes text that repeats the statute (including the 20 percent matching-share rule, which stays in the Native American Programs Act), the template ineligibility letter, and the list of applicable financial regulations, and it keeps the matching-share waiver, maintenance-of-effort waiver, delegation, real-property, and tribal chief executive office cost provisions. Appeals of ineligibility findings, and of suspended or terminated awards or denied continuation funding applications (non-competing continuation applications), would go to the Departmental Appeals Board (DAB) under 45 CFR part 16. HHS says the rule adds no new paperwork burdens and, if finalized, intends to provide training and technical assistance on applicable requirements.

Why it matters for tribal funding

Directly tribal. The document is about tribes, tribal programs or Native organizations specifically.

Who it covers: Tribal governments, Alaska Native villages, Alaska Native corporations, Native Hawaiian organizations, Urban Indian organizations, Native nonprofits.

What to do next

  1. Submit written comments by 2026-11-13 at regulations.gov under ACF-2026-0826 or 0970-AD50, or by the email address in the notice.
  2. Review proposed 45 CFR 1336.2(b) and update internal -management procedures so appeals follow the DAB process at 45 CFR part 16.
  3. Check that your waiver and matching-share procedures match the retained text in proposed 1336.3, and confirm which federal financial requirements still apply to your awards.
