Department of the TreasuryCommunity Development Financial Institutions Fund (CDFI Fund)ConsultationOct 30, 2026

Check: Treasury's CDFI Fund is proposing revisions to the New Markets Tax Credit (NMTC) Community Development Entity (CDE) certification application, which Tribal entities seeking certification would file, and is accepting public comment until 2026-12-29.

What it does

Tribal entities seeking CDE certification, the gateway to NMTC allocations, would complete a revised application. The revisions remove references to "Minority-Owned or Controlled" in an applicant's structure, add an Affiliate Information subsection on ownership, control and foreign interests, add a Government Investigations and Enforcement subsection, and add anti-discrimination, and fraud, waste and abuse language. The notice describes the collection as covering 150 respondents at 4 hours each per year.

Why it matters for tribal funding

Tribes eligible. Tribes or Native organizations are among those who can apply or are covered, alongside others.

Who it covers: Tribal governments.

Rules it touches: 26 CFR 1

What to do next

  2. Review the revised application and guidance at https://www.cdfifund.gov/programs-training/certification/cde, and gather affiliate ownership, control and foreign-interest information in advance if your entity or a Tribal affiliate plans to apply.
