EPA proposes changing aquaculture permit in Indian Country, incl. chlorine checks
Environmental Protection AgencyProposed ruleAug 14, 2026
Check: EPA Region 10 has proposed a modified Clean Water Act discharge permit for federal and Indian Country aquaculture facilities in Washington, which changes chlorine monitoring for every covered facility.
What it does
The NPDES (National Pollutant Discharge Elimination System, the federal permit program for discharges to waterways) general permit is a single permit that covers a whole category of facilities under one set of conditions. The draft modification adds facility-specific conditions for Leavenworth National Fish Hatchery so it can obtain coverage, and it changes chlorine monitoring requirements for all covered facilities, including aquaculture facilities located in Indian country in Washington. Tribally located facilities covered by the permit would operate under the modified conditions.
Why it matters for tribal funding
Tribes eligible. Tribes or Native organizations are among those who can apply or are covered, alongside others.
Who it covers: Tribal governments.
What to do next
- Review the draft modified general permit and Fact Sheet addendum at https://www.epa.gov/npdes-permits/npdes-general-permit-federal-aquaculture-facilities-and-aquaculture-facilities
- Identify any tribal aquaculture facility in Washington covered by WAG130000 and check its chlorine monitoring duties against the proposed change
